Terms and Conditions


1. Defined terms

In these Terms and Conditions, unless the context requires otherwise:

1.1Membership” shall mean membership of the Program, and “Member” shall have a corresponding meaning;
1.2Membership Card” shall mean the card issued to Members for redemption of Program benefits and entitlements;
1.3Practice” shall mean [Practice name, ACN and address]; and
1.4Program” shall mean the loyalty program operated by the Practice.

2. Membership

2.1 Membership is subject to these Terms and Conditions.  By applying for or accepting Membership, each actual or prospective Member is deemed to have read and accepted these Terms and Conditions.
2.2 Membership is available only to individuals and not to businesses or corporations.
2.3 Applications for Membership may be made in-store at the Practice or following an invitation by the Practice to join.
2.4 Membership is activated upon the issue of a Membership Card.
2.5 Only one membership per person is permitted. Membership is non-transferrable.

3. Membership Cards

3.1 Members must present their Membership Cards upon making purchases at the Practice in order to be entitled to redeem any Program entitlements.
3.2 If a Membership Card is lost or stolen, the Member must notify the Practice. A new card will be issued by the Practice to the Member as soon as practicable.

4. Limitations

4.1 Membership entitlements (in the nature of discounts) are not available in respect of already discounted products or special offers.

5. Extra offers, benefits

5.1 Members agree to receive email communications regarding latest Program news, information and offers, and any other form of communications (such as SMS communication) to which the Member agrees with the Practice in writing.  Members will however have the opportunity to unsubscribe to such communications at any time.
5.2 The Practice may from time to time make available to Members additional offers (other than those indicated on the Membership Card itself) in relation to the purchase of goods or services.
5.3 While the Practice shall make reasonable efforts to communicate additional offers and benefits to Members, the Practice does not warrant that each and all such offers will be communicated to all Members and shall be under no liability to any Member in the event that details of any additional offer or benefit is not communicated to any Member.

6. Additional terms and conditions

6.1 These Terms and Conditions are to be read in conjunction with any other terms and conditions of the Practice that may be brought to a Member’s attention in relation to purchases, privacy and other related matters.
6.2 The Practice may terminate a Membership with immediate effect in the event that the Member breaches these Terms and Conditions.
6.3 To the extent permitted at law, the Practice may in its absolute discretion change, modify, suspend, cancel or terminate the Program or aspects thereof (including any entitlements), at any time, subject to the provision of notice to Members.  Such notice may take the form of a notice posted on the Practice’s website (if applicable) or upon the communication of these new terms and conditions to Members in-store or through such other means of communication reasonably determined by the Practice. The Practice will use reasonable endeavours to provide advance notice of such changes where practicable.
6.4 In the event that the Practice terminates this Program, except where the law requires otherwise or if and to the extent the Practice in its reasonable discretion elects to extend the availability of any entitlements, any entitlements available to Program Members will immediately expire.
6.5 The operation of the Program shall be subject to the Practice’s privacy policy.  Details of the privacy policy are available in-store or where applicable at the Practice’s website.
6.6 To the extent permissible at law, the Practice excludes all warranties and accepts no liability in relation to the operation of the Program.
6.7 These Terms and Conditions are governed by the laws of Australia.
